Conditions of sale
The offer and sale of products on INDOMINA SHOP ONLINE, www.indomina.it, are governed by the following General Conditions of Sale. The items purchased on INDOMINA SHOP ONLINE are products sold and characterized by trademarks owned by GGM GROUP SRL, PI 08782771219, with registered office in Naples (NA), Corso Secondigliano 236, (80144)
1. Conclusion of the sales contract
1 - These general conditions of sale are an integral and essential part of the purchase contract concluded between you (our customer) and INDOMINA. Your electronic sending of the order implies full knowledge of these General Conditions of Sale and their full acceptance.
2 - If you do not agree with one or more terms contained in these General Conditions of Sale, please refrain from making purchases on INDOMINA SHOP ONLINE.
3 - When transmitting the order, you will be warned that such forwarding implies the obligation to pay the indicated price.
4 - The purchase contract with INDOMINA is concluded when INDOMINA receives your order electronically, after verifying the correctness of the data contained therein.
5 - Once the purchase contract is concluded, INDOMINA will take charge of your purchase order by sending an email containing the summary of the order. However, this email does not constitute automatic acceptance of the order itself. INDOMINA reserves the right to refuse orders from customers with whom there is an ongoing dispute relating to the payment of a previous order, which do not provide sufficient guarantees of solvency, or which are incomplete or incorrect, or in the event of unavailability of the products. In these cases, INDOMINA will inform you by email that the contract is not concluded and that INDOMINA has not processed your purchase order.
2. Sales prices
1 - All sales prices of the products displayed and indicated within the INDOMINA SHOP ONLINE include VAT and any other tax that may be applicable in relation to the sale; however, they do not include customs duties, import taxes, taxes and customs brokerage fees, if applicable based on the destination of the order. In fact, for some destinations, upon arrival at the border of your country the contents of the order may be subject to customs duties (which may include taxes, duties, management costs, remuneration of customs brokers, etc.), the payment of which is at your expense, as the customer receiving the order. INDOMINA does not have the possibility to calculate these customs duties in advance, therefore we recommend that you contact the competent local authorities or your local customs office for detailed information before placing your order.
2 - The cost of shipping and transport, or other additional costs, if applicable, will be clearly indicated and displayed before completing the order.
3 - Product prices may be subject to updates. As a customer, you are responsible for ascertaining the final sales price before completing the relevant order.
3. Delivery methods
1 - The delivery of the products is carried out exclusively within the territory of the country to which the local INDOMINA SHOP ONLINE refers to which you connected to and which you used for the purchase.
2 - To find out the specific shipping methods for the products, you can access the "Shipping" section. The information contained in this section forms an integral and substantial part of these General Conditions of Sale and, therefore, are considered to be fully known and accepted by you at the time the order is sent. However, it is understood that the shipping and delivery terms indicated are purely indicative and that the products will be delivered at the latest within thirty days of the conclusion of the sales contract.
4. Payment methods
1 - In case of payment by credit card, the payment procedure will take place via a secure connection connected directly to the banking institution that owns and manages the online payment service, which INDOMINA cannot access. In particular, the financial information (for example, the credit/debit card number or its expiration date) will be forwarded, via encrypted protocol, to Banca Sella or other banks, which provide the relevant remote electronic payment services , without third parties having access to it in any way. Furthermore, this information will never be used and/or stored in any format (including electronic) by INDOMINA. The validity of the card may be verified through a payment pre-authorization. This authorization is not a charge. In any case, your credit card will be charged at the time of shipment of the purchased product, without prejudice, obviously, to your customer right to have the amount re-credited in any case of non-fulfilment by the Seller, or failure to execute the contract for any reason.
3 β As a customer, you are solely responsible for the data entered, therefore you guarantee to only use credit cards for which you have legitimate availability.
4 - If you choose the PayPal method, where applicable, you will be redirected to the website www.paypal.com where you will pay for the products according to the procedure established and regulated by PayPal, and to the terms and conditions of the contract agreed between you and PayPal itself. The data entered on the PayPal site will be processed directly by the latter and will not be transmitted or shared with INDOMINA.
INDOMINA is therefore not able to know and does not store in any way the credit card data connected to your PayPal account, or the data of any other payment instrument connected to that account. The total amount due will be charged to you by PayPal upon conclusion of the online contract. In the event of termination of the purchase contract and in any other case of refund, for any reason, the refund amount in your favor will be credited to your PayPal account. The crediting times on the payment instrument connected to this account depend exclusively on PayPal and the banking system. Once the credit order has been placed in favor of this account, INDOMINA cannot be held responsible for any delays or omissions in crediting the refund amount, to contest which you will have to contact PayPal directly.
5. Responsibility
1 - INDOMINA assumes no responsibility for disservices attributable to force majeure such as, by way of example, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevent, in whole or in part, to execute the contract within the agreed times.
2 - INDOMINA will not be liable to any party or third party for damages, losses and costs suffered as a result of failure to execute the contract for the causes mentioned above, you only having the right to a refund of the price paid.
3 - Likewise, INDOMINA is not responsible for any fraudulent or illicit use that may be made by third parties of credit cards, checks and other means of payment, when paying for the products purchased. In fact, at no time during the purchase procedure is INDOMINA able to know your credit card number as, by opening a protected connection, it is transmitted directly to the banking service manager.
4 - The essential characteristics of the products are presented on INDOMINA SHOP ONLINE within each product sheet. However, the images and colors of the products offered for sale may not correspond exactly to the real ones due to the Internet browser and monitor used.
6. Your obligations as a customer
1 - The data entered during the purchase phase must be exclusively your real and personal data and not that of third parties or fantasy. INDOMINA reserves the right to legally prosecute any violation and abuse, in the interest and protection of consumers.
2 β As a customer, you indemnify INDOMINA from any liability deriving from the issuing of incorrect tax documents due to errors relating to the data provided by you, as you yourself are solely responsible for their correct insertion.
7. Right of withdrawal and refunds
1 β As a customer, you can withdraw from the purchase contract concluded with INDOMINA without any penalty and without specifying the reason, within fourteen (14) days, starting from the day of receipt of the products purchased according to the methods set out below.
2 - Before the expiry of the withdrawal period as determined above, you can make the return request directly from the INDOMINA Digital Store by completing and forwarding the return request to INDOMINA via an email addressed to info@indomina.it, which includes the details of the your purchase, the date it was ordered or received and your name and address. Furthermore, shipping will be paid by the customer.
3 β As a Customer, you must return the goods or deliver them to the third party authorized by INDOMINA to receive the goods, without undue delay and in any case within fourteen days from the date on which you communicated to INDOMINA your decision to withdraw from the contract. The deadline is met if you send the goods back before the fourteen day period has expired.
4 - After returning the products, INDOMINA carries out the necessary checks relating to their compliance with the conditions and terms indicated in this section.
6 - If the right of withdrawal is exercised following the methods and terms indicated in this paragraph, INDOMINA will reimburse you for any sums already collected for the purchase of the products.
7 - Whatever payment method you use, the refund is activated by INDOMINA as quickly as possible and in any case within 14 (fourteen) days starting from the day on which you communicated to INDOMINA your decision to withdraw from the contract. INDOMINA may withhold the refund until it has received the products, or until you have demonstrated that you have sent the products back, whichever occurs first.
8. Changes and Updates
1 - INDOMINA reserves the right to modify INDOMINA Digital Store, the policies and these General Conditions of Sale at any time to offer new products or services, or to comply with legal or regulatory provisions. By accessing our Digital Store and placing an order you will adhere to the policies and terms of the General Conditions of Sale in force from time to time at the time the order is placed, unless any changes have retroactive effect under applicable law (in in which case, they may also apply to orders you have placed previously). If any provision of these Conditions is held to be invalid, void or for any reason unenforceable, such condition shall not however affect the validity and enforceability of the other provisions.
